The Spinka money trail -- and the informant who brought them down

The first snow flutters hesitantly in Brooklyn. Men wearing fur streimel
hats and women wearing sheitls walk briskly past the corner of 15th Avenue
and 58th Street in Boro Park as if nothing extraordinary has happened here.

And why not? The kosher shops of this self-contained ultra-Orthodox
neighborhood -- practically a city onto itself -- are still a few blocks
down, and here on this bleak corner, there are only three orange school
buses parked in front of a four-story, dark-red brick building, which sits
on a residential street, where tall, narrow houses nearly overlap. The
structure (photo below) is rather nondescript and unimposing -- garbage 
bags
are piled haphazardly by a front gate, bars protect the windows, young boys
can be heard chanting from behind the locked door and a white sign with sky
blue Hebrew lettering reads: "Yeshiva Imrei Yosef Spinka."


A buzzer sounds. The door opens. No one asks who rang the bell. Up the four
steps, a reception window sits empty. Hazy yellow fluorescent lights
illuminate the narrow hallways adorned with graying yellow paint and frayed
industrial carpeting. If there are millions -- or even thousands -- of
dollars going to the Spinka yeshiva, it certainly doesn't seem like it's
coming here.

This despite the fact that on Dec. 19, 2007, the U.S. Attorney General's
Office filed an indictment in the U.S. District Court for the Central
District of California naming the Chasidic yeshiva and four other Spinka
organizations, as well as eight people, in a multimillion dollar tax fraud
and money-laundering ring that stretched from Brooklyn to Los Angeles to
Israel and elsewhere.

Two of those indicted are Rabbi Naftali Tzi Weisz, 59, the Grand Rabbi of
Spinka, a Brooklyn-based Chasidic sect, whose yeshiva is in this
undistinguished building, and his gabbai (assistant), Moshe Zigelman, 60.

Weisz is just one of a number of Grand Rebbes of Spinka, a Chasidic sect
that originated in Romania in the 19th century. He is the
great-great-grandson of the founding rabbi, and one of about a dozen Grand
Spinka Rebbes who live in Boro Park or Williamsburg, in Brooklyn, or Bnei
Brak and Jerusalem in Israel.

Four Los Angeles men were among those charged with taking part in the
scheme: Yaacov (Yankel) Zeivald, 43, a self-described scribe (sofer) from
Valley Village (photo, right); Yosef Nachum Naiman, 55, the owner of Shatz
Et Naiman, d.b.a. Jerusalem Tours; Alan Jay Friedman, 43, a businessman 
from
Pico-Robertson who sits on the board of the Orthodox Union; and Moshe 
Lazar,
60, owner of Lazar Diamonds, a Los Angeles jewelry company.

Although many of the details of the case have not yet been revealed -- a
trial date is set for Feb. 12, but the defendants' lawyers say it will be
postponed at least a year -- what is emerging from the indictment, the
search warrant and other documents of public record is a complex
money-laundering scheme. According to the documents, people donated money 
to
the Spinka institutions but then received 80 percent to 95 percent of their
donations back, yet wrote off the full amount on their taxes.

These charges are just the beginning of a much larger case, Daniel J.
O'Brien, an assistant U.S. attorney in the major frauds section, based in
Los Angeles, said in an interview with The Journal.

"There were many other people that contributed in this fashion that would 
be
the subject of government investigations," O'Brien said.

While O'Brien said he has documentation that the Spinka institutions took 
in
about $750,000 through the scheme -- then writing receipts for $8.7
million -- in 2007 alone, the assistant U.S. attorney believes the fraud 
has
been going on for decades: "I believe this goes on beyond living memory,"
possibly for generations.

This is certainly not the first time an ultra-Orthodox sect has been 
accused
of attempting to break the laws of the secular government -- aramos, or
schemes, were perpetrated over the centuries in the shtetls of Europe. In
the last decade, arrests have occurred in religious communities in 
Brooklyn,
Lakewood, N.J., and upstate New York.

However, this particular case has shocked Los Angeles' ultra-Orthodox
community, not only because Los Angeles had largely been exempt from such
cases in the past, but also because some of the city's prominent members
have been charged as being at the center of the scheme.

As a result, the case has sparked a fierce debate about the type of 
behavior
that is acceptable for observant people and what type of religious 
community
Los Angeles would like to be. But there's also debate about the laws of a
moser, an informant, because one person who was not charged was the primary
source of information for the federal case -- though he allegedly started
out as one of the perpetrators.



THE BEGINNING

On June 29, 2004, the U.S. Securities and Exchange Commission filed civil
fraud charges against Robert A. Kasirer and four executives of Heritage
Healthcare of America, which sold $131 million in bonds to 1,800 investors
in 36 states from 1996-1999, claiming that the money would be used to fund
10 health care facilities. In October of that year, Kasirer approached the
federal government and "expressed a desire to plead guilty to criminal
charges arising out of the investigation and agreed to reveal other 
criminal
conduct he and others had committed, with a view that any sentence he might
receive would be reduced," according to an affidavit for a search warrant
submitted by FBI Special Agent Ryan Heaton on Dec. 18, 2007.

Although the search warrant affidavit identifies Kasirer only as
"confidential witness (CW-1)" and the recent grand jury indictment refers 
to
a witness named only as RK, the companies in the affidavit attributed to
CW-1 and RK are run by Kasirer, and several members of the Los Angeles
community, who asked for confidentiality, have confirmed his involvement.

In 2004, under federal surveillance, the informant identified in the
transcript as CW-1 resumed activities he admitted to having conducted with
the Spinka since 1990, in which "he caused several million dollars in
contributions to be mailed to the tax-exempt organizations operating within
the umbrella of Spinka," he is quoted in federal documents as having told
the FBI.

As part of the scam, Weisz and Zigelman allegedly would return 80 to 95
percent of Kasirer's contributions.

On Oct. 31, 2007, the SEC issued a final judgment against Kasirer, ordering
him to pay $4,991,434.

"Kasirer consented to the entry of the final judgment without admitting or
denying the allegations contained in the commission's case," according to
the SEC enforcement proceedings.

In the interim, according to the transcripts, Kasirer began to wear a 
device
to record his interactions for the government. On Dec. 20, 2004, he told
Zigelman, the Spinka rebbe's gabbai, that he never intended to pay the SEC.

According to the wiretapped transcripts, Kasirer told Zigelman: "The SEC
investigation is done. But they want me to pay them a lot of money."

"How much?" Zigelman asked.

"Possibly one, one and a half," Kasirer said.

"Million?" Zigelman asked.

Kasirer confirmed the amount and said he had told the SEC he didn't have 
the
money. In the transcript, Kasirer then went on to say that he'd lied to the
SEC, and that, in fact he had the money but wanted to hide that fact.

"What is SEC?" Zigelman asked.

Kasirer explained, and Zigelman replied, "Yes, yes, but you don't have to
give it to them."

For the next three years, Kasirer recorded conversations with targets of 
the
government investigation, and, using government funds, conducted a dozen
monetary transactions with Zigelman, according to transcripts of
conversations conducted in English, Hebrew, Yiddish and Hungarian. The
government also tapped the phones of Zigelman and Weisz.



CASH OR CHARGE?

For Kasirer, there were two ways the operation worked: At first he
reportedly received his "donations" back in cash, and when he became
uncomfortable with the large cash amounts floating around, he set up an
Israeli account.

According to the transcripts, Kasirer's money was allegedly refunded to him
by various men, all now defendants in the case: Naiman, Zeivald, Friedman
and Lazar, all of whom have pleaded not guilty to the charges against them.

Among the transactions in the transcripts, for example, was one on Feb. 8,
2007. Kasirer FedEx-ed a check for $20,000 made out to Yeshiva Imrei Yosef
to Zigelman. On Feb. 15, 2007, Lazar delivered $18,600 to Kasirer's house.
On Feb. 22, 2007, Kasirer got a letter in the mail on a Yeshiva Imrei Yosef
Spinka letterhead thanking Kasirer for his $20,000 donation to a tax-exempt
organization, saying the "donation" was entirely tax deductible and Kasirer
had received no "goods" or "services" in exchange for the contribution.

The Spinka Yeshiva charged Kasirer up to 7.5 percent for laundering the
money, which was a cause for some dispute, according to the wiretaps.

On Dec. 16, 2005, Kasirer told Joseph Roth, an assistant manager at Bank
Mizrahi -- which is based in Israel but has a branch in Los Angeles -- to
set up a new account so he could move money internationally.

On Jan. 12, 2006, Tel Aviv lawyer Jacob Kantor -- the only one of those
named in the indictment who is still at large -- is reported in the
transcripts offering to Kasirer to create documents to incorporate a 
company
called Bedford Holdings & Investments, which would be "held in confidence 
by
the bank and can only be disclosed after a complicated procedure by the 
Bank
of Israel, if there is evidence that the monies resulted from criminal
activities, such as drugs -- tax matters are not an issue." Much like
Switzerland, Israel has laws that protect investors, and the country does
not investigate monetary origins, even on suspicion of tax fraud.

"So, we wanted to basically set everything up the same way as it was
before," Kasirer told Roth in the affidavit transcripts. Later in the
document, he tells Zigelman that Kantor set up a trust in Israel so that
nothing would be left in Kasirer's name in order to hide his money from the
SEC. Then he'd take a loan from the Los Angeles branch of an unnamed 
Israeli
bank, "so I can use the money here." Later, he says in the affidavit, he
would take the money back from Israel and repay the loan here.

Mizrahi Bank, which is never named in the affidavit, is under investigation
by the federal government, according to Assistant U.S. Attorney O'Brien.

"We believe the bank offers this thing as a product to clients in the
U.S. -- the bank pitches this as a money-laundering product. I believe 
there
are multiple agents involved," O'Brien said, including Kantor.

The government also believes that there are many people like Kasirer, "who
occupy the same role as he did in this conspiracy," O'Brien said.

But Kasirer was not the creator of this conspiracy, according to the
government. His father -- the recently deceased Jacob (Yankel) Kasirer who
founded the Bais Yaakov School for Girls on Beverly Boulevard in Los 
Angeles
and is known as a "stalwart" of the Jewish community -- was involved with
the scheme. According to the transcripts, when Kasirer was discussing his
distress over his earlier money-laundering penalty with Lazar, the diamond
dealer said, "It's not something you started."

Kasirer replied, "I was really not aware of what he did with my father."

In addition, in a taped conversation, the Spinka Rebbe told Kasirer he
wanted to meet with his father.

"RK's father was engaged in this prior to RK being involved in it," O'Brien
said in an interview. "We believe that this has origins much earlier than
that -- beyond living memory."




CRIME IS NOT SO BAD

"There are a million ways that religious institutions defraud the
government," said one Brooklyn accountant who asked that his name be
withheld. However, it's not just the Jews, he claimed, "churches do the 
same
thing." Churches and synagogues are exempt from filing tax returns --
although many do -- and the government usually does not audit unless it has
probable cause. As a result, this can make fraud easier.

In the last decade or so, a number of Chasidic institutions on the East
Coast have been charged with such crimes, including the 1997 case against
the Skverer Hasidim in Rockland County, N.Y., where four men were found
guilty of defrauding the government of millions of dollars in federal Pell
Grants. But in the Orthodox community, many defended them, despite the
crime, because the money was used to support needy yeshiva students.

"Nobody here owns a yacht," a resident reportedly said, and the feeling
then -- as with many such institutional fraud cases -- that if the money is
used to help the community and not line someone's pockets, it's not so bad.

That, in fact, is a pervasive attitude these days in Brooklyn, where the
Spinka case raised fewer eyebrows than in Los Angeles, because the attitude
is everyone does something. This kind of discussion has been a hot topic on
many Internet blogs that discuss the ultra-Orthodox community.

"The government are thieves, what gives them the right to take 40 percent 
to
50 percent of someone's income? Anyone who can save yiddishe gelt from 
going
down that toilet is doing a mitzvah," one contributor wrote on the
Vosizneias (Yiddish for "What Is News?") blog.

The blog comments, though, seem to be about evenly divided between two
camps: On one hand are those castigating the government or the bloggers
posting the news for spreading gossip; on the other are those demanding 
that
the community finally put a stop to criminal behavior.

One particularly poignant plea came from New York white-collar defense
attorney Joel Cohen, in an essay published in 2006 titled, "Jewish Felons:
The Problem of Criminality in Observant Communities." Cohen described
witnessing a disturbing rise in crime among Orthodox and Chasidic Jews.

"The problem in the observant community, however, is not merely occasional,
nor does it often make headlines. Daily, in metropolises around the 
country,
yarmulka-wearing criminal defendants appear before the bar of justice," he
wrote.

Some prisons -- especially in New York, Los Angeles and Miami -- have daily
minyans, visiting rabbis, kosher food, classes and Shabbat meals, Cohen
wrote. "The most common charge is fraud: against businessmen and
run-of-the-mill citizens alike, most frequently involving victims outside 
of
the Jewish community, against the government, against insurance carriers,
against banking institutions, health care fraud, money-laundering and
stock-swindling."

Cohen pleads with his fellow Orthodox Jews to denounce the criminal
activity:

"Only with the open denouncement of wrongdoing from within the particular
observant community can the community hope to demonstrate and protect the
Torah's commitment to honesty in one's interpersonal dealings as being at
least equal to, if not greater than, its commitment to technical observance
of mitzvoth," he wrote



DON'T BLAME THE MESSENGER

But the most talked-about aspect of the case -- both among bloggers and at
Shabbat tables on both coasts -- has been the involvement of Kasirer. From
the start, most here guessed accurately who he was -- an informant who
turned state's evidence to save his own skin -- but what they wanted to 
know
was what was he? Was he a moser -- an informer, who, according to
traditional Jewish law, must be killed for turning against a Jew and is
denied access to "the world to come."

The Talmud forbids a Jew to inform on another Jew to a secular government,
even if that Jew violated both secular and Jewish law.

Today, among poskim -- Orthodox rabbinic deciders -- there is a debate over
whether a Jew may turn in another Jew in a democratic state. Some rabbis 
say
that laws of moser do not hold in the United States because they were
established to protect Jews from corrupt and anti-Semitic governments that
would likely torture and give Jews worse treatment than other prisoners 
than
merited by Jewish law.

This is not the case today in a democracy, they say. "These rules apply 
only
to one who informs on another to bandits and so endangers that person's
money and life, as these bandits chase after a person's body and money, and
thus one may use deadly force to save oneself," it is written in the Aruch
Hashulchan, ("Laying the Table," a book about Jewish law written in the 
late
19th century).

But many insist that the laws of moser do apply today, and that it is
forbidden by Jewish law for one Jew to inform on another to any secular
government.

Rabbi Ezra Batzri in "Dinnai Mamonut" ("Laws of Money") says informing is
prohibited. "All rules of informing are applicable even currently .... Even
if they bring all matter to court, it is clear that, through interrogation
and the police, government can destroy people, and in many places they do,
in fact, destroy people."

Some rabbis say you cannot be a moser, even in America, except when the
person doing the questionable act may be a danger to others -- a child
molester, a rapist, a murderer. In those cases, it would be "permitted" to
inform the authorities, writes Rabbi Hershel Schacther, a top posek. Which
means that in the case of financial wrongdoings, a Jew is not allowed to
inform on another Jew.

When the Spinka case broke, the Rabbinical Council of California (RCC)
discussed the informant issue, RCC President Rabbi Meyer May said. But the
council decided to let other halachic authorities deal with the question.

"There is no way to explain how perfidious what RK did is. He violated the
spirit of Jewish law," May said. "Having said that, it doesn't justify what
was done on the other side [by the defendants]."

Although many were focusing on the moser and other justifications like
"everybody does it" and "we pay more taxes than everyone else," that is
beside the point, May said. The point, he continued, is to own up to any
wrongdoings. "Our business is the integrity [of the individual]," he said.
"Something which is wrong is wrong."

Still, others, like lawyer and blog commentator Cohen, argue that it is
precisely such concern about laws like that of moser -- which forbid a Jew
to turn in another Jew to authorities, and chilul Hashem, desecrating God's
name in public, which has created an atmosphere were people are more
concerned with protecting their own than following the laws of the U.S.
government.

"To ignore crime within our ranks does us a great disservice, both because
it weakens us as a community and because tolerating it suggests to the
outside world that Judaism does not promote a righteous moral compass,"
Cohen wrote.



BUSINESS AS USUAL

On Monday morning, Dec. 31, the streets of downtown Los Angeles were eerily
empty; nearly everyone had left town. But the Roybal Federal Courthouse was
open, and by 8:30 a.m. there were enough Chasidic men in the third-floor
corridor for a minyan: 11 -- not to mention a few clean-shaven men wearing
black yarmulkes -- all waiting for the morning's arraignment hearings to
begin.

Grand Spinka Rebbe Weisz didn't converse much with his gabbai Zigelman. The
men pored over Hebrew books -- either studying holy texts or reciting
psalms -- and intermittently conversed with the lawyers. It would be an 
hour
until the court would open and another until their own hearing would begin.

Everyone was anxious for the hearing to start -- not because of the 
upcoming
secular New Year, which the ultra-Orthodox do not celebrate -- but so that
they could return to their homes and to their lives in Brooklyn.

The seven men had been arrested and jailed on Dec. 19, a Wednesday, and 
most
were released before Shabbat.

Weisz and Zeligman had spent another Shabbat in Los Angeles, detained until
the arraignment. The Spinka Rebbe attended Rabbi Chaim Boruch Rubin's
synagogue in Hancock Park -- which itself is entangled in a legal battle
over land use -- and was given the honor of leading services. At this, a 
few
men walked out in protest.

"As a parent in the community and as a rabbi in the community, since there
were children in the room and since we have an obligation to teach our
children right and wrong," one person who left quietly said later. "I have
no problem [with the Spinka Rebbe] sitting in the front in his normal
[honored] seat," but the man who walked out said he would have preferred
"one stage less than normal" to show children "that it's not business as
usual."

When the court opened for the hearing, most of the defendants and their
supporters filed into the first row of the courtroom, except for the
clean-shaven Friedman, who sat in the back, a few seats away from Zeivald,
who was accompanied by an Israeli translator.

A Yiddish translator sat next to the Spinka Rebbe, and only Roth, the
Israeli banker, came from the entrance behind a glass partition, clad in
green prison outfit. He was the only one not yet released on bail, at the
time, because the government said he was believed to pose a flight risk.
Roth remains in custody.

Finally, their turn arrived. The seven filed up front, each with his
separate lawyers. (Famed lawyer Donald Etra, who was originally retained to
defend Weisz, was by then no longer on the case). They each declined to 
have
the charges read to them.

"How do you plead?" Magistrate Judge Alicia G. Rosenberg asked.

One by one, Weisz, Zigelman, Naiman, Zievald, Friedman, Lazar and Roth each
said: "Not guilty."

By 11 a.m., they filed out of the courtroom.

By Shabbat, Jan. 4, the Grand Spinka Rebbe was back in Boro Park to lead 
his
congregation. He's free on $2 million bail, allowed to travel for work in
New York and New Jersey, and of course, to California, where he and
Zigelman, among others, await trial.

The Spinka money trail -- and the informant who brought them down

The first snow flutters hesitantly in Brooklyn. Men wearing fur streimel
hats and women wearing sheitls walk briskly past the corner of 15th Avenue
and 58th Street in Boro Park as if nothing extraordinary has happened here.

And why not? The kosher shops of this self-contained ultra-Orthodox
neighborhood -- practically a city onto itself -- are still a few blocks
down, and here on this bleak corner, there are only three orange school
buses parked in front of a four-story, dark-red brick building, which sits
on a residential street, where tall, narrow houses nearly overlap. The
structure (photo below) is rather nondescript and unimposing -- garbage 
bags
are piled haphazardly by a front gate, bars protect the windows, young boys
can be heard chanting from behind the locked door and a white sign with sky
blue Hebrew lettering reads: "Yeshiva Imrei Yosef Spinka."


A buzzer sounds. The door opens. No one asks who rang the bell. Up the four
steps, a reception window sits empty. Hazy yellow fluorescent lights
illuminate the narrow hallways adorned with graying yellow paint and frayed
industrial carpeting. If there are millions -- or even thousands -- of
dollars going to the Spinka yeshiva, it certainly doesn't seem like it's
coming here.

This despite the fact that on Dec. 19, 2007, the U.S. Attorney General's
Office filed an indictment in the U.S. District Court for the Central
District of California naming the Chasidic yeshiva and four other Spinka
organizations, as well as eight people, in a multimillion dollar tax fraud
and money-laundering ring that stretched from Brooklyn to Los Angeles to
Israel and elsewhere.

Two of those indicted are Rabbi Naftali Tzi Weisz, 59, the Grand Rabbi of
Spinka, a Brooklyn-based Chasidic sect, whose yeshiva is in this
undistinguished building, and his gabbai (assistant), Moshe Zigelman, 60.

Weisz is just one of a number of Grand Rebbes of Spinka, a Chasidic sect
that originated in Romania in the 19th century. He is the
great-great-grandson of the founding rabbi, and one of about a dozen Grand
Spinka Rebbes who live in Boro Park or Williamsburg, in Brooklyn, or Bnei
Brak and Jerusalem in Israel.

Four Los Angeles men were among those charged with taking part in the
scheme: Yaacov (Yankel) Zeivald, 43, a self-described scribe (sofer) from
Valley Village (photo, right); Yosef Nachum Naiman, 55, the owner of Shatz
Et Naiman, d.b.a. Jerusalem Tours; Alan Jay Friedman, 43, a businessman 
from
Pico-Robertson who sits on the board of the Orthodox Union; and Moshe 
Lazar,
60, owner of Lazar Diamonds, a Los Angeles jewelry company.

Although many of the details of the case have not yet been revealed -- a
trial date is set for Feb. 12, but the defendants' lawyers say it will be
postponed at least a year -- what is emerging from the indictment, the
search warrant and other documents of public record is a complex
money-laundering scheme. According to the documents, people donated money 
to
the Spinka institutions but then received 80 percent to 95 percent of their
donations back, yet wrote off the full amount on their taxes.

These charges are just the beginning of a much larger case, Daniel J.
O'Brien, an assistant U.S. attorney in the major frauds section, based in
Los Angeles, said in an interview with The Journal.

"There were many other people that contributed in this fashion that would 
be
the subject of government investigations," O'Brien said.

While O'Brien said he has documentation that the Spinka institutions took 
in
about $750,000 through the scheme -- then writing receipts for $8.7
million -- in 2007 alone, the assistant U.S. attorney believes the fraud 
has
been going on for decades: "I believe this goes on beyond living memory,"
possibly for generations.

This is certainly not the first time an ultra-Orthodox sect has been 
accused
of attempting to break the laws of the secular government -- aramos, or
schemes, were perpetrated over the centuries in the shtetls of Europe. In
the last decade, arrests have occurred in religious communities in 
Brooklyn,
Lakewood, N.J., and upstate New York.

However, this particular case has shocked Los Angeles' ultra-Orthodox
community, not only because Los Angeles had largely been exempt from such
cases in the past, but also because some of the city's prominent members
have been charged as being at the center of the scheme.

As a result, the case has sparked a fierce debate about the type of 
behavior
that is acceptable for observant people and what type of religious 
community
Los Angeles would like to be. But there's also debate about the laws of a
moser, an informant, because one person who was not charged was the primary
source of information for the federal case -- though he allegedly started
out as one of the perpetrators.



THE BEGINNING

On June 29, 2004, the U.S. Securities and Exchange Commission filed civil
fraud charges against Robert A. Kasirer and four executives of Heritage
Healthcare of America, which sold $131 million in bonds to 1,800 investors
in 36 states from 1996-1999, claiming that the money would be used to fund
10 health care facilities. In October of that year, Kasirer approached the
federal government and "expressed a desire to plead guilty to criminal
charges arising out of the investigation and agreed to reveal other 
criminal
conduct he and others had committed, with a view that any sentence he might
receive would be reduced," according to an affidavit for a search warrant
submitted by FBI Special Agent Ryan Heaton on Dec. 18, 2007.

Although the search warrant affidavit identifies Kasirer only as
"confidential witness (CW-1)" and the recent grand jury indictment refers 
to
a witness named only as RK, the companies in the affidavit attributed to
CW-1 and RK are run by Kasirer, and several members of the Los Angeles
community, who asked for confidentiality, have confirmed his involvement.

In 2004, under federal surveillance, the informant identified in the
transcript as CW-1 resumed activities he admitted to having conducted with
the Spinka since 1990, in which "he caused several million dollars in
contributions to be mailed to the tax-exempt organizations operating within
the umbrella of Spinka," he is quoted in federal documents as having told
the FBI.

As part of the scam, Weisz and Zigelman allegedly would return 80 to 95
percent of Kasirer's contributions.

On Oct. 31, 2007, the SEC issued a final judgment against Kasirer, ordering
him to pay $4,991,434.

"Kasirer consented to the entry of the final judgment without admitting or
denying the allegations contained in the commission's case," according to
the SEC enforcement proceedings.

In the interim, according to the transcripts, Kasirer began to wear a 
device
to record his interactions for the government. On Dec. 20, 2004, he told
Zigelman, the Spinka rebbe's gabbai, that he never intended to pay the SEC.

According to the wiretapped transcripts, Kasirer told Zigelman: "The SEC
investigation is done. But they want me to pay them a lot of money."

"How much?" Zigelman asked.

"Possibly one, one and a half," Kasirer said.

"Million?" Zigelman asked.

Kasirer confirmed the amount and said he had told the SEC he didn't have 
the
money. In the transcript, Kasirer then went on to say that he'd lied to the
SEC, and that, in fact he had the money but wanted to hide that fact.

"What is SEC?" Zigelman asked.

Kasirer explained, and Zigelman replied, "Yes, yes, but you don't have to
give it to them."

For the next three years, Kasirer recorded conversations with targets of 
the
government investigation, and, using government funds, conducted a dozen
monetary transactions with Zigelman, according to transcripts of
conversations conducted in English, Hebrew, Yiddish and Hungarian. The
government also tapped the phones of Zigelman and Weisz.



CASH OR CHARGE?

For Kasirer, there were two ways the operation worked: At first he
reportedly received his "donations" back in cash, and when he became
uncomfortable with the large cash amounts floating around, he set up an
Israeli account.

According to the transcripts, Kasirer's money was allegedly refunded to him
by various men, all now defendants in the case: Naiman, Zeivald, Friedman
and Lazar, all of whom have pleaded not guilty to the charges against them.

Among the transactions in the transcripts, for example, was one on Feb. 8,
2007. Kasirer FedEx-ed a check for $20,000 made out to Yeshiva Imrei Yosef
to Zigelman. On Feb. 15, 2007, Lazar delivered $18,600 to Kasirer's house.
On Feb. 22, 2007, Kasirer got a letter in the mail on a Yeshiva Imrei Yosef
Spinka letterhead thanking Kasirer for his $20,000 donation to a tax-exempt
organization, saying the "donation" was entirely tax deductible and Kasirer
had received no "goods" or "services" in exchange for the contribution.

The Spinka Yeshiva charged Kasirer up to 7.5 percent for laundering the
money, which was a cause for some dispute, according to the wiretaps.

On Dec. 16, 2005, Kasirer told Joseph Roth, an assistant manager at Bank
Mizrahi -- which is based in Israel but has a branch in Los Angeles -- to
set up a new account so he could move money internationally.

On Jan. 12, 2006, Tel Aviv lawyer Jacob Kantor -- the only one of those
named in the indictment who is still at large -- is reported in the
transcripts offering to Kasirer to create documents to incorporate a 
company
called Bedford Holdings & Investments, which would be "held in confidence 
by
the bank and can only be disclosed after a complicated procedure by the 
Bank
of Israel, if there is evidence that the monies resulted from criminal
activities, such as drugs -- tax matters are not an issue." Much like
Switzerland, Israel has laws that protect investors, and the country does
not investigate monetary origins, even on suspicion of tax fraud.

"So, we wanted to basically set everything up the same way as it was
before," Kasirer told Roth in the affidavit transcripts. Later in the
document, he tells Zigelman that Kantor set up a trust in Israel so that
nothing would be left in Kasirer's name in order to hide his money from the
SEC. Then he'd take a loan from the Los Angeles branch of an unnamed 
Israeli
bank, "so I can use the money here." Later, he says in the affidavit, he
would take the money back from Israel and repay the loan here.

Mizrahi Bank, which is never named in the affidavit, is under investigation
by the federal government, according to Assistant U.S. Attorney O'Brien.

"We believe the bank offers this thing as a product to clients in the
U.S. -- the bank pitches this as a money-laundering product. I believe 
there
are multiple agents involved," O'Brien said, including Kantor.

The government also believes that there are many people like Kasirer, "who
occupy the same role as he did in this conspiracy," O'Brien said.

But Kasirer was not the creator of this conspiracy, according to the
government. His father -- the recently deceased Jacob (Yankel) Kasirer who
founded the Bais Yaakov School for Girls on Beverly Boulevard in Los 
Angeles
and is known as a "stalwart" of the Jewish community -- was involved with
the scheme. According to the transcripts, when Kasirer was discussing his
distress over his earlier money-laundering penalty with Lazar, the diamond
dealer said, "It's not something you started."

Kasirer replied, "I was really not aware of what he did with my father."

In addition, in a taped conversation, the Spinka Rebbe told Kasirer he
wanted to meet with his father.

"RK's father was engaged in this prior to RK being involved in it," O'Brien
said in an interview. "We believe that this has origins much earlier than
that -- beyond living memory."




CRIME IS NOT SO BAD

"There are a million ways that religious institutions defraud the
government," said one Brooklyn accountant who asked that his name be
withheld. However, it's not just the Jews, he claimed, "churches do the 
same
thing." Churches and synagogues are exempt from filing tax returns --
although many do -- and the government usually does not audit unless it has
probable cause. As a result, this can make fraud easier.

In the last decade or so, a number of Chasidic institutions on the East
Coast have been charged with such crimes, including the 1997 case against
the Skverer Hasidim in Rockland County, N.Y., where four men were found
guilty of defrauding the government of millions of dollars in federal Pell
Grants. But in the Orthodox community, many defended them, despite the
crime, because the money was used to support needy yeshiva students.

"Nobody here owns a yacht," a resident reportedly said, and the feeling
then -- as with many such institutional fraud cases -- that if the money is
used to help the community and not line someone's pockets, it's not so bad.

That, in fact, is a pervasive attitude these days in Brooklyn, where the
Spinka case raised fewer eyebrows than in Los Angeles, because the attitude
is everyone does something. This kind of discussion has been a hot topic on
many Internet blogs that discuss the ultra-Orthodox community.

"The government are thieves, what gives them the right to take 40 percent 
to
50 percent of someone's income? Anyone who can save yiddishe gelt from 
going
down that toilet is doing a mitzvah," one contributor wrote on the
Vosizneias (Yiddish for "What Is News?") blog.

The blog comments, though, seem to be about evenly divided between two
camps: On one hand are those castigating the government or the bloggers
posting the news for spreading gossip; on the other are those demanding 
that
the community finally put a stop to criminal behavior.

One particularly poignant plea came from New York white-collar defense
attorney Joel Cohen, in an essay published in 2006 titled, "Jewish Felons:
The Problem of Criminality in Observant Communities." Cohen described
witnessing a disturbing rise in crime among Orthodox and Chasidic Jews.

"The problem in the observant community, however, is not merely occasional,
nor does it often make headlines. Daily, in metropolises around the 
country,
yarmulka-wearing criminal defendants appear before the bar of justice," he
wrote.

Some prisons -- especially in New York, Los Angeles and Miami -- have daily
minyans, visiting rabbis, kosher food, classes and Shabbat meals, Cohen
wrote. "The most common charge is fraud: against businessmen and
run-of-the-mill citizens alike, most frequently involving victims outside 
of
the Jewish community, against the government, against insurance carriers,
against banking institutions, health care fraud, money-laundering and
stock-swindling."

Cohen pleads with his fellow Orthodox Jews to denounce the criminal
activity:

"Only with the open denouncement of wrongdoing from within the particular
observant community can the community hope to demonstrate and protect the
Torah's commitment to honesty in one's interpersonal dealings as being at
least equal to, if not greater than, its commitment to technical observance
of mitzvoth," he wrote



DON'T BLAME THE MESSENGER

But the most talked-about aspect of the case -- both among bloggers and at
Shabbat tables on both coasts -- has been the involvement of Kasirer. From
the start, most here guessed accurately who he was -- an informant who
turned state's evidence to save his own skin -- but what they wanted to 
know
was what was he? Was he a moser -- an informer, who, according to
traditional Jewish law, must be killed for turning against a Jew and is
denied access to "the world to come."

The Talmud forbids a Jew to inform on another Jew to a secular government,
even if that Jew violated both secular and Jewish law.

Today, among poskim -- Orthodox rabbinic deciders -- there is a debate over
whether a Jew may turn in another Jew in a democratic state. Some rabbis 
say
that laws of moser do not hold in the United States because they were
established to protect Jews from corrupt and anti-Semitic governments that
would likely torture and give Jews worse treatment than other prisoners 
than
merited by Jewish law.

This is not the case today in a democracy, they say. "These rules apply 
only
to one who informs on another to bandits and so endangers that person's
money and life, as these bandits chase after a person's body and money, and
thus one may use deadly force to save oneself," it is written in the Aruch
Hashulchan, ("Laying the Table," a book about Jewish law written in the 
late
19th century).

But many insist that the laws of moser do apply today, and that it is
forbidden by Jewish law for one Jew to inform on another to any secular
government.

Rabbi Ezra Batzri in "Dinnai Mamonut" ("Laws of Money") says informing is
prohibited. "All rules of informing are applicable even currently .... Even
if they bring all matter to court, it is clear that, through interrogation
and the police, government can destroy people, and in many places they do,
in fact, destroy people."

Some rabbis say you cannot be a moser, even in America, except when the
person doing the questionable act may be a danger to others -- a child
molester, a rapist, a murderer. In those cases, it would be "permitted" to
inform the authorities, writes Rabbi Hershel Schacther, a top posek. Which
means that in the case of financial wrongdoings, a Jew is not allowed to
inform on another Jew.

When the Spinka case broke, the Rabbinical Council of California (RCC)
discussed the informant issue, RCC President Rabbi Meyer May said. But the
council decided to let other halachic authorities deal with the question.

"There is no way to explain how perfidious what RK did is. He violated the
spirit of Jewish law," May said. "Having said that, it doesn't justify what
was done on the other side [by the defendants]."

Although many were focusing on the moser and other justifications like
"everybody does it" and "we pay more taxes than everyone else," that is
beside the point, May said. The point, he continued, is to own up to any
wrongdoings. "Our business is the integrity [of the individual]," he said.
"Something which is wrong is wrong."

Still, others, like lawyer and blog commentator Cohen, argue that it is
precisely such concern about laws like that of moser -- which forbid a Jew
to turn in another Jew to authorities, and chilul Hashem, desecrating God's
name in public, which has created an atmosphere were people are more
concerned with protecting their own than following the laws of the U.S.
government.

"To ignore crime within our ranks does us a great disservice, both because
it weakens us as a community and because tolerating it suggests to the
outside world that Judaism does not promote a righteous moral compass,"
Cohen wrote.



BUSINESS AS USUAL

On Monday morning, Dec. 31, the streets of downtown Los Angeles were eerily
empty; nearly everyone had left town. But the Roybal Federal Courthouse was
open, and by 8:30 a.m. there were enough Chasidic men in the third-floor
corridor for a minyan: 11 -- not to mention a few clean-shaven men wearing
black yarmulkes -- all waiting for the morning's arraignment hearings to
begin.

Grand Spinka Rebbe Weisz didn't converse much with his gabbai Zigelman. The
men pored over Hebrew books -- either studying holy texts or reciting
psalms -- and intermittently conversed with the lawyers. It would be an 
hour
until the court would open and another until their own hearing would begin.

Everyone was anxious for the hearing to start -- not because of the 
upcoming
secular New Year, which the ultra-Orthodox do not celebrate -- but so that
they could return to their homes and to their lives in Brooklyn.

The seven men had been arrested and jailed on Dec. 19, a Wednesday, and 
most
were released before Shabbat.

Weisz and Zeligman had spent another Shabbat in Los Angeles, detained until
the arraignment. The Spinka Rebbe attended Rabbi Chaim Boruch Rubin's
synagogue in Hancock Park -- which itself is entangled in a legal battle
over land use -- and was given the honor of leading services. At this, a 
few
men walked out in protest.

"As a parent in the community and as a rabbi in the community, since there
were children in the room and since we have an obligation to teach our
children right and wrong," one person who left quietly said later. "I have
no problem [with the Spinka Rebbe] sitting in the front in his normal
[honored] seat," but the man who walked out said he would have preferred
"one stage less than normal" to show children "that it's not business as
usual."

When the court opened for the hearing, most of the defendants and their
supporters filed into the first row of the courtroom, except for the
clean-shaven Friedman, who sat in the back, a few seats away from Zeivald,
who was accompanied by an Israeli translator.

A Yiddish translator sat next to the Spinka Rebbe, and only Roth, the
Israeli banker, came from the entrance behind a glass partition, clad in
green prison outfit. He was the only one not yet released on bail, at the
time, because the government said he was believed to pose a flight risk.
Roth remains in custody.

Finally, their turn arrived. The seven filed up front, each with his
separate lawyers. (Famed lawyer Donald Etra, who was originally retained to
defend Weisz, was by then no longer on the case). They each declined to 
have
the charges read to them.

"How do you plead?" Magistrate Judge Alicia G. Rosenberg asked.

One by one, Weisz, Zigelman, Naiman, Zievald, Friedman, Lazar and Roth each
said: "Not guilty."

By 11 a.m., they filed out of the courtroom.

By Shabbat, Jan. 4, the Grand Spinka Rebbe was back in Boro Park to lead 
his
congregation. He's free on $2 million bail, allowed to travel for work in
New York and New Jersey, and of course, to California, where he and
Zigelman, among others, await trial.

shoa or holocaust which derived from the Nuremberg trials and were
later "enriched", and what the contemporaries perceived. Remember : no
written orders about an extermination of Jews because they were Jewish
were ever found. 

Latter-day shoa theoricians had to coin the notion of the "nod from Hitler" :
Hitler would have conveyed orders about mass murder of  Jews through body
language. Why ? Out of caution ? Out of fear ? Out of shame ? It does not make
sense to state that the annihilation of Jews was both a state secret and a
concept the German population (or a sizable part of it) knowingly and
willingly went along with

There was no specific hatred of Jewish people. There was a large
measure of fear of bolchevism. The danger was from within : the German
Communist Party was the strongest outside the Soviet Union. 

And many Anti-Communists identified bolchevism as a Jewish cause : 
in Czarist Russia, Jews experienced pogroms, limitation of rights. Many of
them welcomed the fall of the Czar, and in Russia a lot of them were
instrumental in the establishment of the Communist regime. 

That applies with the post-WW1 era. More generally, there was a feeling that
Jewish influence (among others) was behind the 1918 defeat, the revolution and
the civil war which broke out in its aftermath : Jews could have sided
with the Entente after Russia withdrew from the war and Britain
declared itself for the establishment of a Jewish Homeland in
post-Ottoman Palestina. 

There was some distrust of the Jewry (in France, after the 1870 defeat, some
remarked that a Jewish adviser to Chancellor Bismarck was the one who induced
him to demand a 5 billion gold franks contribution within the 10 May 1871
Treaty of Frankfurt from France; and others observed that Jews at large,
especially corporate decision-makers had favoured Bismarck' policies of German
unification which France clumsily had opposed because it deprived it
forever of any hope of geopolitical dominance on mainland Europe, and
not just of Alsace and Northern Lorraine)

Well, French and Spaniards were aliens, outside the country.
 Jews were within and outside, and seemed to rule the Soviet Union. 
Germans and Spaniards would find it difficult to hate each other because they
don't have common borders or opposite interests in general. In WW1, Portugal
which had always been close to Britain (even in the Middle-Ages,
England helped Portuguese to free themselves from the Arabs), joined
the Entente, something the Spanish king could not consider to do : the
Spaniards resented French influence, and disliked the Anti-Catholic,
freemasonic republican regime in France. In France, the words
"republic" and "republican" do not just mean what you can read in the
dictionnaries : they are coded words which convey a measure of adhesion
to political correctness (even before the expression was ever invented)

Many more than 7 million innocent Ukrainian Christians died in the holocaust 
which ZYDS want to be "forgotten" - HOLODOMOR in Ukraine!

Five years ago, I wrote about the unknown Holocaust in Ukraine. I was shocked
to receive a flood of mail from young Americans and Canadians of Ukrainian
descent telling me that until they read my column, they knew nothing of the
1932-33 genocide in which Josef Stalin's Soviet regime murdered seven million
Ukrainians and sent two million more to concentration camps. 
How, I wondered, could such historical amnesia afflict so many? For Jews and
Armenians, the genocides their people suffered are vivid, living memories that
influence their daily lives. Yet today, on the 70th anniversary of the
destruction of a quarter of Ukraine's population, this titanic crime has
almost vanished into history's black hole. 

So has the extermination of the Don Cossacks by the communists in the 1920s,
the Volga Germans in 1941 and mass executions and deportations to
concentration camps of Lithuanians, Latvians, Estonians and Poles. At the end
of World War II, Stalin's gulag held 5.5 million prisoners, 23% of them
Ukrainians and 6% Baltic peoples. 

Almost unknown is the genocide of two million of the USSR's Muslim peoples:
Chechens, Ingush, Crimean Tatars, Tajiks, Bashkirs and Kazaks. The Chechen
independence fighters who today are branded as "terrorists" by the U.S. and
Russia are the grandchildren of survivors of Soviet concentration camps. 
Add to this list of forgotten atrocities the murder in Eastern Europe from
1945-47 of at least two million ethnic Germans, mostly women and children, and
the violent expulsion of 15 million more Germans, during which two million
German girls and women were raped. 

Among these monstrous crimes, Ukraine stands out as the worst in terms of
numbers. Stalin declared war on his own people in 1932, sending Commissars V.
Molotov and Lazar Kaganovitch and NKVD secret police chief Genrikh Yagoda to
crush the resistance of Ukrainian farmers to forced collectivization. 
Ukraine was sealed off. All food supplies and livestock were confiscated. NKVD
death squads executed "anti-party elements." Furious that insufficient
Ukrainians were being shot, Kaganovitch - virtually the Soviet Union's Adolf
Eichmann - set a quota of 10,000 executions a week. Eighty percent of
Ukrainian intellectuals were shot. 

During the bitter winter of 1932-33, 25,000 Ukrainians per day were being shot
or died of starvation and cold. Cannibalism became common. Ukraine, writes
historian Robert Conquest, looked like a giant version of the future
Bergen-Belsen death camp. 

The mass murder of seven million Ukrainians, three million of them children,
and deportation to the gulag of two million more (where most died) was hidden
by Soviet propaganda. Pro-communist westerners, like The New York Times'
Walter Duranty, British writers Sidney and Beatrice Webb and French Prime
Minister Edouard Herriot, toured Ukraine, denied reports of genocide, and
applauded what they called Soviet "agrarian reform." Those who spoke out
against the genocide were branded "fascist agents." 

The U.S., British, and Canadian governments, however, were well aware of the
genocide, but closed their eyes, even blocking aid groups from going to
Ukraine. 

The only European leaders to raise a cry over Soviet industrialized murder
were, ironically and for their own cynical and self-serving reasons, Hitler
and Italian dictator Benito Mussolini. 

Because Kaganovitch, Yagoda and some other senior Communist party and NKVD
officials were Jewish, Hitler's absurd claim that communism was a Jewish plot
to destroy Christian civilization became widely believed across a fearful
Europe. 

When war came, U.S. President Franklin D. Roosevelt and British PM Winston
Churchill allied themselves closely to Stalin, though they were well aware his
regime had murdered at least 30 million people long before Hitler's
extermination of Jews and gypsies began. Yet in the strange moral calculus of
mass murder, only Germans were guilty. 

Though Stalin murdered three times more people than Hitler, to Roosevelt he
remained "Uncle Joe." 

The British-U.S. alliance with Stalin made them his partners in crime.
Roosevelt and Churchill helped preserve history's most murderous regime, to
which they handed over half of Europe in 1945. 

After the war, the left tried to cover up Soviet genocide. Jean-Paul Sartre
denied the gulag even existed. 

For the western Allies, Nazism was the only evil; they could not admit being
allied to mass murderers. For the Soviets, promoting the Jewish Holocaust
perpetuated anti-fascism and masked their own crimes. 

The Jewish people, understandably, saw their Holocaust as a unique event. It
was Israel's raison d'etre. Raising other genocides at that time would, they
feared, diminish their own. This was only human nature. 

While today, academia, the media and Hollywood rightly keep attention focused
on the Jewish Holocaust, they mostly ignore Ukraine. We still hunt Nazi
killers, but not communist killers. There are few photos of the Ukraine
genocide or Stalin's gulag, and fewer living survivors. Dead men tell no
tales. 

Russia never prosecuted any of its mass murderers, as Germany did. 
We know all about the crimes of Nazis Adolf Eichmann and Heinrich Himmler;
about Babi Yar and Auschwitz. 

But who remembers Soviet mass murderers Dzerzhinsky, Kaganovitch, Yagoda,
Yezhov and Beria? Were it not for writer Alexander Solzhenitsyn, we might
never know of Soviet death camps like Magadan, Kolyma and Vorkuta. Movie after
movie appears about Nazi evil, while the evil of the Soviet era vanishes from
view or dissolves into nostalgia. 

The souls of Stalin's millions of victims still cry out for justice.

Ghostbusting in Ukraine

A funny thing. No sooner does my commentary on Communist ghosts appear in
The Ukrainian Weekly than Ukraine responds.

Any connection? In your dreams, Kuropas.

But it's reassuring to learn that 68 democrats in Ukraine's Parliament
have neither forgiven nor forgotten the ethnocide perpetrated by the
Bolsheviks against the Ukrainian people.

Led by Lev Lukianenko, Yevhen Proniuk and Les Taniuk, the 68
parliamentarians have established Nuremberg II. The purpose, reports
Chrystyna Lapychak in a May 6 story carried by the service UNIAR press, is
to organize a symbolic international trial on crimes committed by the
former Communist Party of the Soviet Union and the Communist Party of
Ukraine. "The legislators plan to use the caucus to collect evidence, hold
public hearings and conferences, and maintain links with parliaments of
other former Soviet republics," reads the release.

It's a brilliant move. Since it's probably unrealistic to assume that,
given the present dominance of the Communist nomenklatura, Ukraine will
soon, if ever, bring anyone to trial, it is at least possible to document
Ukraine's Bolshevik barbarism.

Ukraine needs to authenticate these historical antecedents in some formal
way. The recent past needs to be recorded in its entirety for three major
reasons:
1) to expose the bestial Bolshevik abominations in all their horror in the
hope that they will never be repeated (communism won't go away unless a
silver spike is driven through its wretched heart);
2) academics, both in Ukraine and elsewhere, seem to be shying away from
writing the truth about Ukraine's Bolshevik past;
3) Ukraine can no longer pretend that what transpired between 1920 and
1991 was a mere aberration in a long history. It wasn't. Before Ukraine
can be whole again, past realities, as painful as they may be, must be
addressed.

We in North America can assist Ukraine's ghostbusters in a number of ways.

could serve as a reminder of Communist malevolence is an idea worthy of
our support...

Publications in the English language are another way we in North America
can help. There are countless areas that could use the light of truth. We
could begin with the story behind the Russian Bolshevik invasion of
Ukraine, its forced incorporation into the USSR, and the subsequent
annihilation of hundreds of Ukraine's own nationally oriented Bolsheviks
as well as thousands of scholars, editors, teachers and others whose
loyalty to Ukraine superseded loyalty to Lenin and Stalin.

Let the chips fall where they may. The inordinate role played by Jews in
bringing Bolshevism to power is certainly a topic worthy of further
exploration.

Another aspect of this early Bolshevik period was the total destruction of
the Ukrainian Autocephalous Orthodox Church, which resulted in Siberian
exile or death for thousands of priests and prelates. This history has yet
to be written.

The famine, of course, also requires further research. Yes, there already
are excellent publications on the famine, but we need more. There are
hundreds of books on the Jewish Holocaust. There should also be hundreds
of books on the Ukrainian famine, a malefaction that has no equal in world
history.

There are some excellent books on the killing fields of Vinnytsia as well,
but more documentation is required. We know that in 1943, approximately
9,000 Soviet citizens were found buried in mass graves in the Ukrainian
city of Vinnytsia. It was later established that they were executed by the
Bolsheviks during the years 1937 and 1938. Significantly, none of the
persons killed had been sentenced to death. "In cases where an official
conviction could be linked to a victim," writes Ihor Kamenetsky in "The
Tragedy of Vinnytsia," "either through documentary evidence or on the
basis of the testimony by relatives, the maximum sentence was a term of 10
years' confinement in a labor camp with the denial of the right to
correspondence."

There is also testimony available regarding Soviet butchery of Ukrainian
nationalists as the Germans were approaching the city of Lviv in June of
1941. Unable to evacuate the thousands of prisoners incarcerated following
the Soviet occupation of Galicia, thousands of Ukrainians were simply
massacred in their cells.

The destruction of the Ukrainian Catholic Church by Soviet authorities and
the murder and deportation of thousands of Ukrainian clergy and laity is
still another subject requiring more research. Members of the underground
Church are still alive and could provide excellent testimony.

There are other crimes, some hardly known or mentioned, that need to be
exposed by Nuremberg II and by others. We can't pretend that Bolshevism
was one, big, misguided but well-intentioned error. 'Mistakes" were made,
we are told by devotees of socialism, but the goal was an honorable one.
This is the kind of spin the Left in America is already putting on the
collapse of the Soviet Union.

In an article titled "Socialism Would Strengthen the Republic's
Economies," for example, Mike Davidow argues that it was not socialism
that destroyed the Soviet empire but "retrogression," which was largely
the result of "ideological disorientation." Socialism in the USSR
"constituted a higher state in the progress of mankind," he writes. Mr.
Davidow mourns the Soviet demise because the Bolsheviks played "a
progressive role on the world scene for seven decades" and had "a positive
influence on social development." Mr. Davidow and others like him are one
more reason for setting the record straight.

Once again our community has an obligation to remind the world that no
people, not even the Jews, suffered more during the 20th century than the
Ukrainians....

While Goldhagen is certainly correct that the Nazi propaganda ministry
demonized the Jews, he is overlooking a factor of great importance by
dismissing everything as being a mere "hallucination." Propaganda becomes
especially potent when it builds on elements of truth. The Nazis were able
to capitalize on the fact that many Jews did play important roles in the
Communist leadership, and Jews comprised a disproportionate number of the
local party officialdom in the Ukraine, Lithuania, Latvia, and other
areas. Peter Lawrence, in his article "Why Lithuania?" points out that in
Byelosrussia the Jews comprised about 8 percent of the population, and
while only 6.2 percent were members of the Communist party they comprised
23.2 percent of Party Committees at the district level. Nazi estimates for
the Soviet Union (cited on p. 49 in The Einsatzgruppen Reports edited by
Yitzhak Arad et al , 1989), were that the Jews comprised 1.77% of the
general population, 5.2% of the Communist party membership, 25.7% of the
party's Central Committee, and 36.8% of the Politburo, with the latter
percentage rising to 42.9% by the end of Lenin's era. In other words, Jews
had greater public visibility within the Communist bureaucracy, greatly
exceeding their percentage of the population....

Compounding the deadly intensity of this image, the Germans and the
peoples of Eastern Europe were well aware that the Soviet government had
launched ruthless pogroms of genocidal proportion against various ethnic
groups in the Soviet Union. World concern was aroused during the 1920s and
1930s when millions of Ukrainians and Volksdeutsch died as a result of the
deliberate Soviet policy to exterminate these ethnic groups through mass
starvation. The Ukrainians initially hailed the German troops as
liberators who would remove the Bolshevik yoke from their backs. Nazi
propaganda was relentless in its message: either victory, or total slavery
under the Jewish Bolsheviks.

While Goldhagen acknowledges on p. 393 the link drawn by the Nazi
propagandists between Bolshevism and World Zionism, he fails to emphasize
the crucial importance of this belief. Rather than focusing on how German
fears were aroused by rampant Communism in the east (an historically
specific, "situational" factor), he prefers to focus on the deep,
long-term historical roots of hallucinatory anti-Semitism, to which he
devotes an entire section of his book....

Russian Jewish Elites And Anti-Semitism

Twice in their history, Russian Jews have been associated in the public
mind with the ruling elite. During the early period of Bolshevism, Jews
played prominent roles in the ruling Communist Party and in the economic,
cultural, and academic life of the young Soviet state. Then, after the
collapse of communism in 1991, Jews again achieved influential positions
in politics as well as in the private sector, especially the media...

On the other hand, the presence of Jews in the Russian elite is cause for
concern among Jews themselves, who fear a backlash of anti-Semitism. As
one Russian Jewish leader has explained, “People here have quite bitter
memories of the participation of Jews in the [Bolshevik] revolution.”

Jews in Soviet Elites, 1917-88

. Jews flooded into Russia’s economic, political, and cultural life. At
the same time, in proportions quite exceeding their percentage in the
general population of the Russian Empire, they played a highly visible
role in various movements hostile to the existing order-as liberal critics
of the autocratic regime, as Marxists, or as active exponents of
revolutionary terrorism.

After the fall of czarism and the establishment of Bolshevik rule, legal
discrimination against minorities was ended. Scores of Jews became
prominently involved in the destruction of the old regime and the
construction of the new society. Among the first echelon of leaders of the
new Russia were a number of Jews and individuals of Jewish origin.
Outstanding among these were Lev Trotsky (Bronstein), Grigory Zinovyev
(Radomyslskiy), Lev Kamenev (Rosenfeld), Yakov Sverdlov. There were also
some Jews in the second echelon: Moisey Uritskiy, Adolf Yoffe, Karl Radek
(Sobelson), Grigory Sokolnikov (Briliant), Yuri Steklov (Nekhamkes). These
Jewish Bolsheviks were not especially interested in Jewish matters and in
fact were Jewish only by accident of birth or because they were so
identified in their papers.....

To some Russians it appeared that Jews had taken over the country. Given
the total absence of Jews in the bureaucracy before 1917, their presence
among the state and party leadership and their prominence in the Soviet
military and secret police during the first years of Bolshevik rule
confirmed this impression......

When in the mid-1920s Stalin mounted a campaign against his major
opponents inside the party-a group that was labeled the “left opposition”
and included such prominent Jewish Bolsheviks as Trotsky, Kamenev, and
Zinovyev-his propaganda was spiced with thinly veiled anti-Semitism. In
October 1926 Trotsky, Kamenev, and Zinovyev were deprived of all their
posts in the party’s upper echelon, marking the beginning of the end of
Jewish prominence within the Soviet political elite.

The Shapoval volume, then, provides us with one such reason why some
Ukrainian anti-Semitism might exist. The reason is that Ukrainians have
been aware of the Jewish domination of the experiment in government
through mass murder which went under the name of "Communism," and in which
experiment Ukrainians more than any other peoples have been conscripted
into playing the role of guinea pigs.

Jewish Conquest of the Slavs

The Shapoval volume.  The analyses that I present below are based on
information in the following book written in Ukrainian, with some of its
documentation presented in Russian:

For the sake of brevity, I will refer to the above book as "the Shapoval
volume."

Nationalities in the Cheka-GPU-NKVD. One may summarize my chief finding
with this succinct approximation:

Out of every 10 senior members
of the Cheka-GPU-NKVD in Ukraine:
6 were Jewish,
2 were Russian,
1 was Ukrainian, and
1 was other.

Latvians.  Latvians led in the "other" category.  More specifically:

Almost no mixed parentage.  Given that the authors noted the instance in
which only the father was Jewish, it would appear that there are no other
instances of known mixed parentage in this sample.

Almost no females.  In Ukrainian, the word for "a Latvian person" comes in
masculine and feminine versions, and thus it was possible to note upon no
more than seeing their nationality stated that six of the Latvians were
male and one female.  But as all the other nationality names also come in
two versions, then it would also have been possible to note the presence
of a female in them as well, which however I failed to do.  Thus, in the
sample of 160 for which nationalities were specified, there appears to be
only a single female.  The Cheka-GPU-NKVD in Ukraine, then, appears to
have been a male-dominated occupation.

Possible under-estimate of Jewish participation.  The "Polish/German"
above refers to a single official who was inconsistent in identifying his
nationality on various documents, sometimes stating Polish and sometimes
German.  Two possibilities come to mind: first, that neither of these is
his true nationality; second, that other officials may have misrepresented
their nationality more consistently and thus avoided detection.  More
specifically, as Jews commonly assumed non-Jewish names and concealed
their Jewish identity, it is possible that the above statistics constitute
an under-estimate of Jewish presence in the Cheka-GPU-NKVD.

The Shapoval volume offers some evidence in confirmation of this
hypothesis.  That is, in listing the names of the 183 Cheka-GPU-NKVD
officials, when the official used more than one name or changed his name,
Shapoval included the aliases in parentheses.  The number of names
containing parentheses was 20.  Of these, 14 were Jewish, 3 Latvian, 1
Russian, 1 German, and 1 unknown.  Thus, it would appear that the changing
of names was overwhelmingly a Jewish phenomenon.  Furthermore, my
impression is that the name changes tended to be in the direction of
making the names less Jewish and more Slavic, though as this conclusion
requires the exercise of judgment, and as in several cases I did not trust
my judgment, I do not here quantify the direction of the name changes.
Four examples of names that seemed to go from Jewish to Slavic were:

Declining to guess nationality from name?   Among the 23 for whom
nationality was not specified, I noticed a few cases in which nationality
might be inferred from the name alone.  For example, although no
nationality was specified for Solomon Isaakovych Goldman, one might
venture to guess that he is more likely Jewish than Russian or Ukrainian.
I conclude that either the authors had independent evidence concerning
Goldman's nationality but failed to specify it as an oversight, or else
that they had insufficient biographical data to infer nationality, and
followed the general rule of declining to do so from name only.  Of course
if the Shapoval authors declined to guess that Solomon Isaakovych Goldman
was Jewish, then I decline to do so as well, leaving him uncategorized
with respect to nationality.

A minor paradox resolved.  It should go without saying that even if the
Communist Revolution was controlled mostly by Jews, it does not follow
that most Jews were either Communists or revolutionaries.  Rather, many
writers go out of their way to comment that only a minority of Jews
supported Bolshevism, most were indifferent, and some opposed it.  Thus,
although in the first of the pair of quotations below, we see Hilaire
Belloc unequivocally placing responsibility for the Russian Revolution at
the feet of the Jews, yet in the second of the pair of quotations we find
him unequivocally exonerating Jews in general from blame — a seeming
paradox which a little thought demonstrates contains no contradiction:

It was the pure despotism of a clique, the leaders of which had been
specially launched upon Russia under German direction in order to break
down any chance of a revival of Russian military power, and all those
leaders, without exception, were Jews, or held by the Jews through their
domestic relations, and all that followed was done directly under the
orders of Jews, the most prominent of whom was one Braunstein, who
disguised himself under the assumed name of Trotsky.  A terror was set up,
under which were massacred innumerable Russians of the governing classes,
so that the whole framework of the Russian State disappeared.  Among
these, of course, must specially be noted great numbers of the clergy,
against whom the Jewish revolutionaries had a particular grudge.  A clean
sweep was made of all the old social organization, and under the despotism
of this Jewish clique the old economic order was reversed.

Jews present obstacle to the rule of law in Ukraine.  One of Ukraine's
most pressing needs today is to demonstrate the rule of law by punishing
the most egregious violations of the law — namely torture, murder,
genocide.  To the degree that the number of the guilty and the weakness of
the law make this unfeasible, Ukraine then needs more than anything else
to at least implement a Truth and Reconciliation Commission paralleling
the Truth and Reconciliation Commission so wisely instituted in South
Africa.  However, there is one huge obstacle standing in the way either of
the punishment of the guilty or of inducing them to confess.  That
obstacle is that a disproportionate number of the accused, or of those
revealed to have committed crimes, might turn out to be Jews, with the
result that Ukraine would be portrayed by a mindless world press as having
gone on an anti-Semitic rampage.  Thus, one way that Jews continue to harm
Ukraine today is by standing in the way of Ukraine demonstrating the power
of its law to bring its torturers and its butchers to account, or the
power of its righteousness to command its torturers and its butchers to at
least confess....

Kuhn Loeb & Co. arbeitete auch nach der Revolution bestens mit den Bolschewiki
zusammen. Das Bankhaus beteiligte sich an der Finanzierung des ersten
Fünfjahrplanes. 600 Millionen Dollar in Gold gingen allerdings von Russland an
